Florida Chapter 558 notice belongs in the repair dispute file

Chapter 558 can add a notice-and-cure step to some Florida construction disputes, so the contract and paper trail belong together early.

Many Florida building-defect cases need a written Chapter 558 notice before a lawsuit is filed. The usual wait is at least 60 days. An association with more than 20 parcels will often need at least 120 days. The notice must describe each claimed problem well enough for the other side to find it.

This gives the builder, trade, supplier, or designer time to inspect and reply. It does not prove that every crack or leak is a covered defect, and it does not promise a repair. Other time limits can keep running. A fast leak or weak part may also need quick work to protect the home while the claim is reviewed.

Save the contract, change orders, permits, photos, reports, email, warranty, and repair bills. Put the dates in order while they are still easy to recall. Then ask a Florida lawyer who handles building claims how the notice fits the contract and other deadlines. Early advice can help the owner protect the home and send the right paper without guessing at the clock.
